Terms and Conditions

These Terms and Conditions of Sale (“Terms”) apply to all sales of products and services by Dalmatian Fire Equipment, LLC (“Seller”) to the purchaser (“Buyer”). By purchasing from Seller, Buyer agrees to be bound by these Terms.

All equipment provided by Seller is cleaned and tested. SCBA units are shipped with a current functional test, and used cylinders include a current hydrostatic test. Harnesses may exhibit heat discoloration. Facepieces may be lightly used and may show cosmetic wear, including scuffed lenses, provided that such wear does not impair vision.

Buyer is responsible for inspecting all equipment upon receipt and prior to use. Seller shall not be liable for any damages or injuries resulting from improper use, misuse, neglect, or failure to follow applicable safety guidelines or procedures.

Limited Warranty – Seller provides a limited five (5) year warranty on SCBA equipment unless otherwise stated in writing. This warranty covers defects in workmanship under normal use and service.

As part of this warranty, Seller will provide:

  • One (1) complimentary visual inspection and functional test per SCBA within twenty-four (24) months of shipment (shipping and battery costs excluded); and
  • One (1) complimentary hydrostatic test per cylinder within sixty (60) months of shipment.

To maintain warranty coverage, SCBA units must undergo a visual inspection and functional test at least every twenty-four (24) months.

Seller provides cleaned, inspected, and tested self-contained breathing apparatus (“SCBA”) and related equipment. All inspection, maintenance, and repair work is performed using only original equipment manufacturer (“OEM”) parts specified for the applicable SCBA model and in accordance with the manufacturer’s published service and technical procedures. All SCBAs are flow tested using calibrated Honeywell POSICHEK 3 testing equipment, with calibration maintained in accordance with manufacturer specifications. Seller performs repairs to harnesses and head straps using materials consistent with OEM specifications, including Kevlar® thread, Nomex® materials, and Kevlar® webbing. Seller does not mix components between different manufacturers and does not substitute parts between different SCBA models. Seller is not a manufacturer-authorized or certified dealer unless expressly stated in writing. Seller supplies OEM cylinders for use with SCBAs and is a hydrostatic testing facility certified by the U.S. Department of Transportation (“DOT”) through the Pipeline and Hazardous Materials Safety Administration (“PHMSA”). Seller may also supply DOT/PHMSA-certified cylinders from non-OEM sources. Such cylinders may not meet all manufacturer specifications or applicable standards, including but not limited to those established by the National Fire Protection Association or other applicable federal, state, or local requirements. Seller makes no representation or warranty that any non-OEM configuration complies with manufacturer certifications, NFPA standards, or other regulatory requirements. Buyer is solely responsible for verifying compliance with all applicable standards, specifications, jurisdictional requirements, department policies, and applicable codes, and for determining suitability for Buyer’s intended use.

PFAS Disclosure – Products sold or distributed by Seller may contain per- and polyfluoroalkyl substances (“PFAS”), including but not limited to fluoropolymers, perfluoropolyethers (PFPE), polytetrafluoroethylene (PTFE), and related chemistries. PFAS may be present in coatings, seals, gaskets, valves, lubricants, and other materials necessary for product performance and reliability. Seller provides this notice in accordance with applicable laws and regulations, including Colorado House Bill 19-1279, based on generally available industry and manufacturer information. Seller does not independently test for or verify the presence or absence of PFAS in any product and may not have access to complete product-specific PFAS disclosures from all manufacturers or suppliers. Buyer acknowledges that PFAS regulations vary by jurisdiction and may include disclosure requirements, restrictions, or prohibitions. Buyer agrees that it is solely responsible for determining the applicability of PFAS-related laws to its purchase, use, resale, or distribution of the products and for ensuring compliance with all applicable laws and regulations. Seller makes no representations or warranties regarding PFAS content or regulatory compliance for any specific jurisdiction or application.

Regulatory Compliance – Buyer is solely responsible for determining whether it or its organization is subject to the requirements of the Texas Commission on Fire Protection and for ensuring that any equipment purchased from Seller complies with all applicable TCFP standards, regulations, and guidelines.

Order Processing – Please allow five (5) to ten (10) business days for order processing. Equipment is refurbished and tested prior to shipment. A Sales Order Confirmation will be issued within twenty-four (24) hours confirming receipt of the order. If any item is out of stock, Buyer will be notified.

Shipping – Title to and risk of loss for all products pass to Buyer upon shipment from Seller’s facility, regardless of shipping method or carrier. Buyer assumes all risk of loss or damage in transit and is responsible for filing any claims with the carrier.

Payment Terms – Payment is due upon receipt unless otherwise agreed in writing. Past-due amounts may accrue interest or late charges at the maximum rate permitted by applicable law. Invoices unpaid after ninety (90) days may be referred to collections or legal counsel. Buyer agrees to pay all reasonable costs of collection, including attorney’s fees, court costs, and related expenses, to the extent permitted by law.

Warranty Disclaimer – Except for the limited warranty expressly set forth herein, Seller makes no additional warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Seller does not warrant that any product will meet the requirements of any standard or code, including but not limited to those established by the National Fire Protection Association, unless expressly stated in writing.

Limitation of Liability – To the maximum extent permitted by law, Seller shall not be liable for any indirect, incidental, or consequential damages, including loss of use, revenue, or profits. Seller’s total liability shall not exceed the amount paid by Buyer for the specific product giving rise to the claim.

These Terms and any dispute arising out of or related to the sale of products or services by Seller shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located within the State of Colorado, and the parties hereby consent to the personal jurisdiction and venue of such courts. The parties waive any objection to venue, including claims of inconvenient forum.
